Rule 33
Powers and Procedures of Military Special Courts

(1) The Military Special Court shall have the following powers:-
(a) to hear other persons or evidence relevant to the case in addition to the plaintiff-defendant's witnesses,
(b) to make a statement or affidavit to a defendant or a witness who fails to appear on time,
(c) to set a date for the trial of any aspect of the case or to bring it up when necessary or to appear at a specific time,
(d) If it is not seen from the evidence obtained immediately that an accused should be kept in custody and tried, demand bail or bail from him in view of the amount he has caused damage or unlawfully taken and also the imprisonment or fine he may be liable to,
(e) Based on the evidence immediately received, if there is sufficient and reasonable reason to remand the accused in custody, remand him in custody,
(f) Based on the seriousness of the charge against an accused, the position of the accused, the amount and nature of the crime, to withhold any property of such accused, not to issue a passport to such an accused or, if it has already been issued, to order the concerned body to suspend the said passport.
(2) In the initiation and settlement of the case, as far as written in this paragraph, and in other matters besides this paragraph, the military special court may use the same powers and procedures as the district court in accordance with the prevailing law.
(3) Under Clause (a) of Section 68 of the Act, the Special Military Court shall exercise the following powers and procedures in dealing with and disposing of appeals against judgments or final orders passed by General Military Courts and Summary General Military Courts:-
(a) To uphold, set aside and partially set aside the decisions of General Military Courts and Summary General Military Courts,
(b) To make judgments or final orders which the General Military Court and the Summary General Military Court may make,
(c) If the General Military Court and the Summary General Military Court fail to understand the evidence relating to the questions to be tried in the case, the General Military Court and the Summary General Military Court shall try it themselves or maintain the case.To send the evidence to the Missile Court to understand,
(d) If the General Military Court and the Summary General Military Court have decided on some of the questions to be decided in the case and have not decided on some of them, they will decide on the rest of the questions and send the case to the Missile Court.
(e) Exercising powers similar to those of the court in accordance with the prevailing law, including summoning parties and witnesses, making statements or affidavits, hearing evidence, filing documents and imposing penalties. Apart from what is written in the Act or this regulation, it can determine its own procedure in other matters.
